These Terms of Service ("Terms") govern your access to and use of the WickScan website at wickscan.net and related services (collectively, the "Service") operated by WickScan ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features, you must create an account using an email address or a third-party sign-in provider (e.g., Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

3. Description of Service

WickScan provides AI-powered candlestick chart pattern recognition and analysis tools for educational and informational purposes. Users can upload chart images and receive automated analysis identifying potential technical patterns, support/resistance levels, and trade considerations.

4. No Financial Advice

The Service is provided for educational and informational purposes only. Nothing on WickScan constitutes financial advice, investment advice, trading advice, or any other sort of professional advice. You should not treat any of the Service's content as such.

All analysis, pattern recognition, trade ideas, and other outputs generated by the Service are algorithmic in nature and should not be relied upon as a basis for making financial decisions. Trading and investing in financial markets involves substantial risk of loss. You are solely responsible for your own trading and investment decisions.

Past pattern recognition does not guarantee future results. We make no representations or warranties regarding the accuracy, completeness, or reliability of any analysis provided by the Service.

5. Subscription Plans & Payments

5.1 Free Tier

We offer WickFree, a free plan with no credit card required. You can start scanning immediately with no time limit and no payment information needed.

5.2 Paid Plans

Paid subscription plans (WickPro and WickAlpha) provide additional features and higher usage limits. Pricing is displayed on our pricing page and is subject to change with notice.

5.3 Billing

Paid subscriptions are billed on a recurring monthly basis through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle. All fees are in U.S. dollars unless otherwise stated.

5.4 Upgrades & Downgrades

You may upgrade your plan at any time. Upgrades take effect immediately and any price difference is prorated and charged to your payment method. Downgrades take effect at the end of the current billing period.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload malicious files, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service without permission
  • Resell, redistribute, or sublicense the Service or its outputs
  • Interfere with or disrupt the integrity or performance of the Service
  • Misrepresent your identity or impersonate another person

7. Intellectual Property

The Service, including its design, features, code, content, logos, and trademarks, is owned by WickScan and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of the chart images you upload. By uploading content, you grant us a limited, non-exclusive license to process and analyze it solely for the purpose of providing the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ANALYSIS WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WICKSCAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless WickScan and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
